Quail at Mummy Mountain The term "Mountain Preserve" identifies all property included in the Mummy Mountain Preserve area. The current total Mountain Preserve land atop Mummy Mountain encompasses approximately 320 acres.

The term "Mountain Trust Land" identifies property owned or controlled by the Trust. Currently there is a total of approximately 217 acres (of the 320 Mountain Preserve acres) held by the Mummy Mountain Preserve Trust. One hundred eighty-five (185) acres are held in Fee Title and the remaining thirty-two (32) acres are Conservation Easements.

The purpose of the Mummy Mountain Preserve Trust is to acquire, maintain, preserve and protect in perpetuity undeveloped real property and developed real property that can be returned to its natural state on and around the Mountain Preserve.

The goal of the Trust is preservation of the natural landscape, desert plants, wildlife and scenic beauty of the mountain areas of the Town of Paradise Valley.

The Trust qualifies as an organization exempt from federal and Arizona State income tax. The Trust operates for charitable purposes as defined in federal Code § 501 (c) (3).

The duration of the Trust is perpetual and may only be amended to assure compliance with federal and Arizona State income, estate, gift or generation-skipping transfer tax requirements.

The Trustees may accept and receive additions to the Trust which represent donations from individuals and entities, in cash or other property acceptable to the Trustees.

Real property within the Mountain Preserve may not be re-designated or deleted from the Mountain Preserve. Real property may be added to the Mountain Preserve at the discretion of the Trustees.

Mountain Trust Land owned or controlled by the Mummy Mountain Preserve Trust may not be conveyed, sold, traded, or otherwise alienated, leased, subleased, mortgaged, pledged, hypothecated, secured or collateralized, burdened, encumbered, vacated, abandoned, re-designated or partitioned in any manner, or deleted from the Mountain Preserve or from the Trust estate.

No access or use shall be permitted, licensed or otherwise authorized on any Mountain Trust Land except as may be required for police and public utility functions.

The general powers of the Trustees are broad so the Trustees may properly manage the assets held by the Trust. These powers are specifically limited with respect to the conditions defined in the previous paragraph, i.e. no Mountain Trust Land may be conveyed, sold etc.

To protect the assets held, the Trustees have the power to clean-up Trust property, to assure it is maintained safe and not in violation of any federal, state or local law, rule or ordinance.

The Mummy Mountain Preserve Trust consists of five (5) Trustees appointed by the Mayor of the Town of Paradise Valley, subject to confirmation by the Town Council. Trustees serve for three-year staggered terms ending October 1 of each year. Trustees may be re-appointed for succeeding three-year terms.

Trustees must be a resident of the Town of Paradise Valley and shall be at least twenty-one (21) years of age.
